DMCA Policy
Darius Rochebin Macron ("we", "us", "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified in the sample notice below.
This policy describes the information that should be present in a DMCA notice to Darius Rochebin Macron and the actions we may take in response to such a notice, as well as the procedure for submitting a counter-notification.
Filing a DMCA Notice of Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Darius Rochebin Macron website or service, please send a written notification of claimed infringement to our Designated Copyright Agent (please use the contact link below to initiate communication, specifying "DMCA Notice" in your subject line). - Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s)).
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA notice, we will remove or disable access to the infringing material and notify the user who posted the content. We may also, in appropriate circumstances, terminate the accounts of repeat infringers.
DMCA Counter-Notification
If you believe that the material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification by contacting us through the provided contact link, specifying "DMCA Counter-Notification" in your subject line. Your counter-notification must include substantially the following information (please consult your legal counsel or see Section 512(g)(3) of the DMCA to confirm these requirements):
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., URL(s)).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Darius Rochebin Macron may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If the copyright owner does not file an action seeking a court order to restrain the user from engaging in infringing activity within 10 to 14 business days of receiving the counter-notification, we may, at our discretion, restore the removed material or re-enable access to it.
